Deborah K Bates Consultancy - Service and Payment Terms & Conditions

The following conditions apply to all services offered by Deborah K Bates Consultancy.

All agreements, payments and payment plans for Products and Services provided to the client or customer by Deborah K Bates Consultancy, are subject to the following terms and conditions.

Engaging in a service with Deborah K Bates Consultancy implies full acceptance of these conditions.

1. Acceptance
Payment of advanced fee/deposit or online payment is deemed an acceptance of these terms and conditions, a copy of which is available via our website.

2. Turnaround Time and Content Control
Deborah K Bates Consultancy will provide the Customer's project by the agreed date wherever possible, unless a delay is specifically requested by the Customer and agreed to by Deborah K Bates Consultancy.

2.1. Adherence to the agreed completion date will be dependent upon the customer providing required project work such as manuscripts, notes, and written content in a timely manner that is relevant to the agreed timeframe.

2.2. If content is not provided within sixty (60) days from the original email request then the customer will be considered to be in default of the agreement, and the project will be suspended and the customer sent the final invoice for immediate payment. Deborah K Bates Consultancy will agree, at its sole discretion, to recommence the project after agreement is reached on a revised quotation document and once the original fees have been paid in full.

3. Additions/Extras
Any additional items, pages or other features requested by the customer that are not included in the original quote, will be assessed by Deborah K Bates Consultancy and quoted and billed separately. The customer will be sent an invoice via email or PayPal, to include these additional or extra items on their project.

4. Payment "Standard"
The fees of the service is to be paid as follows:
- 60% advance to get the project started.
- 40% upon completion (agreed completion) of the accomplishment of the project.

5. Cancellation/Termination/Refund Requests
Cancelling a service should be considered a last resort as it affects everybody and with large projects a loss of other business occurs to accommodate your service.

5.1 Termination of services must be requested in a written notice and will be take effect thirty (30) days after receipt of such notice. Telephone requests for termination of services will not be honoured until confirmed in writing, whether via email or hard copy mail.

5.2 All terminations / cancellations will incur an administration fee of $150.

5.3 Upon termination of services, the customer will be invoiced for any work completed up to the date of first notice of request for cancellation, for payment in full within thirty (30) days.

5.4 No refund will be given to cancellations if work has already commenced. The customer/client is not entitled to the sum advanced to Ghostwriter / Commissioner / Editor for initiating the project as described in section 4.

5.5 Upon the discretion of Deborah K Bates Consultancy, a refund on any monies paid minus a fee of 30% of the total project fee will be given in extenuating circumstances. An administration fee will still apply as described in 5.1.

5.6 Any projects contracted between the client/customer and Deborah K Bates Consultancy which have remained dormant (client/customer's default) for a period of 12 months will not receive any refund on monies paid.

6. Copyright
The customer retains the copyright to data, files and all written work unless agreed upon otherwise.

7. Confidentiality
Deborah K Bates Consultancy will not use other than for this Agreement, or disclose to any third party any knowledge or information obtained by or imparted to during or in connection with the fulfilment of this Agreement which is considered of a confidential nature relating to the business strategies, products, services or processes related to the customer.

7.1. The obligation of this confidence will cease to apply regarding any information Deborah K Bates Consultancy is required to disclose by law.

8. General
These Terms and Conditions supersede all previous representations, understandings or agreements. Making payment of an advance fee/deposit, constitutes agreement to and acceptance of these Terms and Conditions. Payment online is an acceptance of our terms and conditions. Deborah K Bates Consultancy reserves the right to change any of the Terms and Conditions at any time and without prior notice

9. Governing Law
This Agreement shall be governed by applicable Australian and Queensland laws.
